After decades of work by lawyers, advocates, and legislators, the Connecticut Legislature enacted two Uniform Laws, which will help bring consistency to the practice of Mediation and Collaborative Divorce in our State. Both the Mediation and Collaboration processes help clients resolve differences voluntarily, without a third-party judicial decision-maker.
The Uniform Mediation Act and the Uniform Collaborative Law Act became effective on October 1, 2025. With a few exceptions, these laws apply broadly to mediation and collaborative cases, not just cases involving divorces, separation, child custody and annulments. These uniform laws provide meaningful and important guidance to professionals who practice in these areas by establishing clear legal standards for confidentiality, ethical practice, and mediated or collaborative out-of-court settlements. With consistent standards in place, clients can be assured that the mediation or collaborative processes will be consistent for all parties.
